These Terms of Use constitute a contract between you and DoorForged LLC and/or its subsidiaries or affiliates (collectively, “DoorForged,” “DoorForged LLC,” “we,” “us,” or “our”). They include (i) an agreement to arbitrate all claims, (ii) disclaimers of warranties, and (iii) limitations of liability. The Intellectual Property Notice in Section 24 is fully incorporated herein.

1 · Acceptance of Terms

Your use of doorforged.com and any DoorForged mobile app or online application (collectively, the “Sites”) and all related information, reports, images, products, services, and data (collectively, the “Services”) is governed by these Terms of Use. If a separate written agreement between you and DoorForged covers certain Services, that agreement controls for those Services.

2 · Changes to Terms

DoorForged may update these Terms of Use at any time by posting the revised version on the Sites (changing the “Last Updated” date) or by otherwise notifying you. Continued use of the Services constitutes acceptance of the revised Terms.

3 · License & Access

DoorForged grants you a revocable, non‑transferable, non‑sublicensable, non‑exclusive license to access and use the Services for:

• Personal, non‑commercial purposes; or

• Internal business purposes (for you and limited “Permitted Users” acting solely on your behalf).

Each property address in DoorForged marketing data may be used once for direct‑marketing activity. Except as expressly allowed, you must not share, resell, or redistribute the Services.

4 · Additional Use Restrictions

You and Permitted Users must not:

• Use bots, scrapers, or similar tools to harvest data

• Reverse‑engineer, decompile, or disassemble any portion of the Services

• Frame, deep‑link, publish, or display Services publicly without prior consent

• Merge or combine the Services with any other dataset for resale or database creation

• Use the Services outside the United States or for any purpose regulated by the Fair Credit Reporting Act

• Disclose DoorForged as a data source in marketing materials (unless legally required and with prior written notice to DoorForged)

Unauthorized use may result in termination of access.

5 · Confidential Information

Each party agrees to safeguard the other’s Confidential Information using at least the same degree of care it uses to protect its own. Obligations survive termination. Certain legal disclosures are permitted with notice.

6 · User‑Provided Materials

You grant DoorForged a perpetual, worldwide, royalty‑free license to use, reproduce, distribute, and create derivative works from any content you or Permitted Users submit (“User Provided Material”). You warrant that you own or have the right to license such material.

7 · Fees

For paid Services, you agree to pay all fees, taxes, and delivery charges, and you authorize DoorForged to charge the payment method provided.

8 · Registration & Communications

Creating an account forms a business relationship; DoorForged may contact you via phone, text, or email (with opt‑out options). You must keep account credentials confidential and accurate.

9 · Termination

DoorForged may terminate your account at any time. Either party may terminate upon uncured breach after 30 days’ notice (or immediately if incurable). Upon termination you must cease use and destroy all copies of Services data.

10 · Third‑Party Links

Links on the Sites to external websites are provided for convenience; DoorForged does not endorse or control those sites and is not liable for any resulting loss.

11 · Service Disruptions

Access may be unavailable or delayed due to factors beyond DoorForged’s control (e.g., hardware failure, natural disasters).

12 · Indemnification

You will indemnify and hold DoorForged harmless from any third‑party claims arising from (i) your use of the Services, (ii) User Provided Material, or (iii) violation of these Terms.

13 · Representations & Warranties

Each party warrants it has authority to enter these Terms. Except as expressly stated, the Services are provided “AS IS” without warranties of any kind.

14 · Limitation of Liability

DoorForged is not liable for indirect, incidental, consequential, or punitive damages. Aggregate liability is capped at the total fees you paid DoorForged in the preceding three months.

15 · Records & Audits

You must retain direct‑marketing records for 12 months. DoorForged may audit compliance upon reasonable notice.

16 · Relationship of the Parties

The parties are independent contractors; no agency, partnership, or joint venture is created.

17 · Assignment & Waiver

DoorForged may assign these Terms; you may not without DoorForged’s written consent. Failure to enforce any provision is not a waiver.

18 · Equitable Relief

DoorForged may seek injunctive relief for breaches involving licenses, confidentiality, or intellectual‑property rights without posting bond.

19 · Dispute Resolution (Arbitration)

All disputes will be resolved by binding arbitration in Orange County, California, under AAA rules. No class actions. If arbitration is unenforceable, exclusive jurisdiction lies in state or federal courts in Orange County, California.

20 · Governing Law

These Terms are governed by California law, without regard to conflict‑of‑law principles.

21 · Severability

If any provision is unenforceable, the remainder will remain in force, and the parties will substitute an enforceable term reflecting original intent.

22 · Entire Agreement

These Terms supersede all prior agreements regarding the Services.

24 · Intellectual Property Notice

DoorForged may run award programs; participation is free, subject to eligibility, and governed by the detailed rules in this section (formerly “StellaPura Award Rules”). Key points:

• Winners notified by email; unclaimed awards may be re‑awarded

• Awards have no cash value; taxes are winners’ responsibility

• Disputes resolved by arbitration in Washoe County, Nevada
